Defamation (Slander/Libel)

The terms libel, slander, and defamation are frequently used interchangeably. They are all related in that they all fall under the same general area of law that deals with false statements that harm someone’s reputation. This broad area of law is known as defamation law. Defamatory statements include libel and slander. Libel is a written defamatory statement. Slander is an oral defamatory statement.

Historically, the distinction between libel and slander was significant, with real-world consequences for how a case was litigated, including the elements that had to be proven and who bore the burden of proof.
